Overview

Thank you for purchasing a product from Viberide Inventions LLC. We stand behind the quality of our products and offer this warranty to ensure your satisfaction and peace of mind. This warranty applies to all non-apparel products sold by Viberide Inventions LLC, and is governed by the laws of the State of Utah, USA. The warranty period is one (1) year from the date of fulfillment of the original order, and covers malfunctions occurring outside of the expected use of the product. Please read this warranty carefully, as it outlines the terms and conditions under which we will repair or replace a defective product. If you have any questions or concerns about this warranty, please contact us using the information provided at the end of this document.

SECTION 1 - LAW

This product warranty is governed by the laws of the State of Utah, USA.

SECTION 2 - TYPE OF WARRANTY

This is an express manufacturer warranty.

SECTION 3 - DURATION

This warranty lasts for one (1) year from the date of fulfillment of the original order.

SECTION 4 - COVERED DEFECTS

This warranty covers malfunctions occurring outside of the expected use of the product. "Expected use" means the use of the product as it is intended to be used, as specified in the product documentation or instructions. It does not cover general wear and tear of any of the parts, joints either internal or external of the product, nor does it cover misuse, including a failure to adhere to our maintenance guidelines.

Misuse includes, but is not limited to:
     •  Using the product for purposes other than its intended use.
     •  Failing to follow our maintenance guidelines or instructions.
     •  Using the product in a manner that exceeds its stated capacity or load rating.
     •  Subjecting the product to extreme temperatures, humidity, or other environmental conditions.
     •  Using the product with non-compatible accessories or components.

We reserve the right to determine whether a malfunction is covered under this warranty at our sole discretion following a warranty claim.

SECTION 5 - EXCLUSIONS AND LIMITATIONS

This warranty excludes misuse, not adhering to maintenance guides, abuse of the product, and neglect. It also does not cover any damage or malfunction that is caused by accidents, acts of God, or other events beyond our control. The remedy for a valid warranty claim is a replacement of the product only.

SECTION 6 - PROCEDURES FOR MAKING A CLAIM

To make a claim under this warranty, visit our Contact Us page and choose the drop-down option "Malfunction". The customer must provide all images requested, as well as proof of purchase, which can be a copy of the original sales receipt or invoice. This must be submitted within one (1) year of the order being fulfilled from our warehouse. We reserve the right to require additional information or documentation to process the claim.

SECTION 7 - DISPUTE RESOLUTION

We reserve the right to accept or deny a claim based on the nature of the malfunction. If the claim is approved, a replacement product will be issued. If we deny the claim, we will provide an explanation of our decision.

In the event of a dispute regarding this warranty, the parties shall first attempt to resolve the dispute through good faith negotiations. If the dispute cannot be resolved through negotiation, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall be held in Salt Lake County, Utah, and the award rendered by the arbitrator shall be final and binding.

SECTION 8 - DISCLAIMER

Our company sells longboard brakes as a convenience to our customers, with the aim of ensuring that our products are of the highest quality and meet all applicable safety standards. However, the use of our products involves certain inherent risks, and we cannot guarantee that the use of our products will not result in injury, death, or damage to property.

It is advised that you use our products only as intended and in accordance with all instructions and safety guidelines provided. Longboarding is an inherently dangerous activity, and it is your responsibility to use our products safely and responsibly. By purchasing our products, you acknowledge and agree to assume all risks associated with the use of our products, and you agree to hold our company and its officers, directors, employees, and agents harmless from any and all claims, damages, or injuries that may arise from the use of our products.

We reserve the right to modify or amend this disclaimer at any time without notice. Your continued use of our website or products after any such modifications or amendments shall constitute your acceptance of the revised terms.

SECTION 9 - WARRANTY PERIOD

The warranty period begins on the date that the original order is fulfilled from our warehouse, and ends one (1) year later. A replacement product does not reset the warranty period.

SECTION 10 - REMEDY

If a product covered by this warranty malfunctions within the warranty period, we will, at our option, repair or replace the product. 

The remedy provided in this section is the sole and exclusive remedy for any breach of this warranty. We shall not be liable for any incidental or consequential damages arising from the use or inability to use the product, or for any other reason.

SECTION 11 - LIMITATION OF LIABILITY

Our liability for any claim arising from this warranty shall be limited to the purchase price of the product. This limitation of liability shall apply to any and all claims, regardless of the legal theory under which such claims are asserted.

SECTION 12 - DISCLAIMER OF WARRANTIES

Except for the express warranty provided in this document, we make no warranties, express or implied, with respect to the product, including but not limited to any implied warranties of merchantability or fitness for a particular purpose. We make no representations or warranties that the product will meet your requirements, or that it will be free from defects or errors.

SECTION 13 - SEVERABILITY

If any provision of this warranty is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 14 - ENTIRE AGREEMENT

This warranty constitutes the entire agreement between you and us with respect to the product, and supersedes all prior or contemporaneous communications and proposals, whether oral or written. No modification of this warranty shall be effective unless it is in writing and signed by both parties.

SECTION 14 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Viberide and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, Service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

SECTION 15 - FORCE MAJEURE

In the event that Viberide Inventions LLC ceases operations, or is unable to fulfill its warranty obligations for reasons beyond its control, including but not limited to natural disasters, war, terrorism, or other events that prevent the operation of the business, Viberide Inventions LLC shall not be obligated to fulfill any outstanding warranties. In such an event, Viberide Inventions LLC will use its best efforts to notify its customers and provide alternative remedies, if available. This section does not affect any warranties that are in effect at the time that Viberide Inventions LLC ceases operations.
